 A consultation session will be held on Wednesday  18th January 2017 at 10am at the ERA Boardroom, Hexagon House, Spencer Hill, Marsa, MRS 1441. Deadline for comments is 28th  March 2017.
 
  • Consultation on draft Daily Penalty Regulations, 2017

A Public Consultation exercise is being launched regarding the drafting of ‘Daily Penalty Regulations’. 
These regulations will replace the ‘Daily Penalty Regulation’ presently in force, (S.L. 549.72 enacted by Legal Notice 276 of 2012, and amended by Legal Notice 124 of 2015). These draft regulations propose the introduction of daily penalties for environmental offences.
 
In this respect, the regulations will function as follows:
 
1.  Where an infringement listed under any Schedule of these regulations is carried out, ERA gives notice in writing to the offender.
2.  This notice will establish the applicable relevant penalty as established in the Schedule and an administrative fine of €100.
3.  The daily penalty starts arruing after 15 days from the Notice of the Authority in which 15 days the offender can rectify the infringment without incurring any penalties.

These regulations
will target those who repeatedly persist to disregard the law.
Offences that fall under this draft LN include:
·   Failure to submit data reporting and information under the Regulations established in the Schedule within the specified deadline as required by the Authority;
·   Operation without authorisation; and
·   Failure to comply with any permit condition or any lawful order issued by the Authority.
