Title of the public consultation: Transposition of Directive 2024/1785/EU: the revised Industrial and Livestock Rearing Emissions Directive (IED 2.0)

- Background
Directive (EU) 2024/1785 introduces significant updates to the Industrial Emissions Directive.
Transposing this Directive into national legislation requires several amendments to existing legislation, as well as the drafting of new regulations concerning the intensive rearing of poultry and pigs. In total, nine legal notices have been drafted.
The Directive is transposed through one framework legal notice which sets out the general principles and obligations, and six subsidiary legal notices covering the following topics or activities:
- Integrated Pollution Prevention and Control (IPPC);
- Large Combustion Plants;
- Emissions of Volatile Organic Compounds (VOC);
- Waste Incineration;
- Installations producing Titanium Dioxide;
- Intensive Rearing of Poultry and Pigs.
The permitting mechanisms for the Intensive Rearing of Poultry and Pigs are being established through a Level III category under the Environmental Permitting (Procedure for Applications and their Determination) (Amendment) Regulations. This approach introduces a simplified permitting procedure proportionate to the sector’s environmental risk, while still ensuring effective environmental protection.
For landfills within scope of this Directive, new BAT (Best Available Techniques) conclusions will be developed, rendering existing references in the current Waste Management (Landfill) Regulations redundant. The latter Regulations are therefore being amended accordingly.
This structure aims to streamline compliance and improve clarity for affected operators by ensuring that obligations are clearly defined for each sector. It is also intended to ensure a smooth transition from the previous transposition of the Industrial Emissions Directive (EU) 2010/75.
Directive (EU) 2024/1785 introduces tighter emission limit values, reinforced requirements for the application of BAT, and increased transparency in permitting and monitoring. It also emphasizes digitalisation of permitting procedures, more robust enforcement mechanisms, and alignment of standards across Member States. Its scope has been expanded to cover a broader range of industrial activities. It now applies to a wider array of installations, including hydrogen production, and battery manufacturing amongst others. The requirements around large-scale livestock farms has been revised. The Directive promotes decarbonisation, circular economy practices, and energy efficiency by requiring the integration of updated BAT into environmental permits.
The Directive also requires the implementation of an electronic permitting system by 2035, aimed at reducing administrative burdens and improving regulatory efficiency. Enforcement mechanisms have been strengthened, with minimum penalties set at 3% of an operator’s EU-wide turnover for serious breaches, and legal avenues made available for individuals to seek redress for environmental and health-related harm.
The Directive (EU) 2024/1785 must be transposed into national law by 1st July 2026.

In line with Article 55 of the Environment Protection Act (Cap. 549), the public is invited to make submissions to ERA with their comments as to why and how these draft regulations could be amended.
