- Background
The Limitation of Emissions of Certain Atmospheric Pollutants Regulations’ (S.L. 549.124) require amendments in order to transpose the Commission Delegated Directive (EU) 2024/299 of 27 October 2023 amending Directive (EU) 2016/2284 of the European Parliament and of the Council on the methodology for the reporting of projected emissions of certain atmospheric pollutants. This Delegated Directive amended Annexes I and IV of Directive (EU) 2016/2284, which correspond to the First and Third Schedules of S.L. 549.124. The purpose of the amendment is to adapt the Directive to ensure that it is fully in line with the recently updated Guidelines for Reporting Emissions and Projections Data under the Convention on Long-Range Transboundary Air Pollution (the LRTAP Convention). The revised Reporting Guidelines establish that emission projections should be reported following the individual nomenclature for reporting (NFR) source categories, as opposed to the source sectors.
The proposed Regulations include a new reporting template for the reporting of air pollutant emissions, removing the need to aggregate emissions projections, simplifying the reporting process to match the format used for historical emissions.
This new requirement will necessitate updating of current reporting procedures by the Environment & Resources Authority to the EU and the LRTAP Convention. No other stakeholder or entity will be impacted by this change.

In line with article 55 of the Environment Protection Act (Cap. 549) the public is invited to make submissions to ERA with their comments as to why and how these regulations could be amended.
