- Background
In accordance with regulation 5(4) of the Waste Management (Electrical and Electronic Equipment) Regulations, S.L. 549.89, any WEEE collected through systems financed by Local Councils or by any other local agency and entering Wasteserv (Civic Amenity Sites) must be:

- handed over to the Producer Responsibility Organisations (PROs) at a rate that reflects the full cost of collection and storage; and
- proportionally allocated by EEE category among the PROs, based on the average weight of EEE placed on the market by their members over the previous three years, as determined by ERA.
The aim of these amendments is to ensure a more representative distribution of WEEE falling under Category 1 (Temperature exchange equipment) amongst the PROs. The proposed allocation procedure based on the new sub-categories will ensure that allocation of Category 1 WEEE to the PROs is based on the waste that arises from the EEE which is actually placed on the market by sub-category by their members.
In view of this, the amendment proposes to introduce the following three sub-categories under Category 1:

- refrigerators, freezers and equipment which automatically delivers cold products;
- air conditioning equipment;
- other temperature exchange equipment.
Furthermore, Schedule 17 of the proposed amendments establishes the methodology for the allocation by the new sub-categories.

In line with Article 55 of the Environment Protection Act (Cap. 549), the public is invited to make submissions to ERA with their comments as to why and how these draft regulations could be amended.
