1. Background
The draft Waste Management (End of Life Vehicles) (Amendment) Regulations, 2020 transpose the provisions of article 1 of Directive (EU) 2018/849 of the European Parliament and of the Council amending Directives 2000/53/EC on end-of-life vehicles, 2006/66/EC on batteries and accumulators and waste batteries and accumulators, and 2012/19/EU on waste electrical and electronic equipment. This directive forms part of the “Waste Legislative Package”, which is composed of 4 directives, adopted in 2018 as part of the Circular Economy Action Plan. The overarching aim of this Waste Legislative Package is to improve waste management within the EU, in order to move further towards a true circular economy.
At the national level, the EU Directive on ELVs was transposed through the Waste Management (End of Life Vehicles) Regulations, S.L. 549.36. The latter regulations designate the Environment and Resources Authority, the Malta Competition and Consumer Affairs Authority and the Authority for Transport in Malta as the national competent authorities for the different provisions of these regulations according to their designated responsibilities.
2. Proposed amendments
The amendments brought about by the proposed draft Waste Management (End of Life Vehicles) (Amendment) Regulations, 2020, include the following:
- Changes to definitions in order to harmonise these with EU legislation as well as the framework Waste Regulations (S.L. 549.63); and
- Clarification that certificates of destruction issued by authorised treatment facilities established in other Member States are to be mutually recognised and accepted in Malta.
