- Background
The new EU Waste Shipment Regulation (i.e. Regulation (EU) 2024/1157 of the European Parliament and of the Council of 11 April 2024 on shipments of waste, amending Regulations (EU) No 1257/2013 and (EU) 2020/1056 and repealing Regulation (EC) No 1013/2006) entered into force on 20 May 2024. Most of the provisions will become applicable as from 21 May 2026 while most export rules will apply from 21 May 2027.
Although the new EU Waste Shipment Regulation, is directly applicable and does not require transposition, some provisions require implementation at national level, such as the designation of the national Competent Authority and penalty regime.
Overview of proposed amendments to the Waste Management (Shipment of Waste) Regulations (S.L. 549.65)
Amendments to the national legislation are being proposed to clearly indicate the competent authority, to remove definitions that are no longer required, and to clarify the timelines for payment of the administrative fee in view of the shift in the new EU Waste Shipment Regulation to a digital system for the processing and approval of documents pertaining to transboundary movement of waste.
The provisions on penalties are also being aligned with the new EU Waste Shipment Regulation, which requires Member States to give due regard to certain criteria (such as the extent of the infringement, the economic benefit derived, etc.) when penalties are established.

In line with Article 55 of the Environment Protection Act (Cap. 549), the public is invited to make submissions to ERA with their comments as to why and how these draft regulations could be amended.
