functions and responsibilities

The Board of the Authority, established by virtue of Article 6 of Chapter 549 of the Laws of Malta, oversees and ensures that the following functions carried by ERA’s three’s Directorates:

  • Environment and Resources (ERD)
  • Regulatory Affairs (RAD)
  • Corporate Services (CSD)

All the three Directorates work together with the mission to safeguard the environment for a sustainable quality of life.

The ERD is responsible for formulation and implementation of polices relating to the protection and management of the environment related to water, biodiversity, nature, marine environment, ambient air quality, ambient noise, waste, provision of information and issuing of subsidiary plans under Chapter 549 of the Laws of Malta on matters relating to the environment.

The RAD is responsible for regulating activities or operations which may have an effect on the environment through permitting, and assessment of development proposals with the aim of avoiding or mitigating the adverse impacts on the environment at planning stage. It is also responsible for ensuring compliance of operators with permits issued by the Authority and enforcement of environmental offences, and for ensuring that national and international obligations relative to the matters regulated by or under the Environment Protection Act come into force and complied with. 

 

The CSD is responsible with the provision of Human Resources, Administration, IT&T, Financial Management, Procurement and other operational support for the Authority.

Details of Internal Complaints

Procedure

An applicant whose request for information is refused, or who is otherwise not satisfied with the information provided, its format or the extension of the deadline for the submission of the notification indicating whether a request would be met or not, may address a complaint to the Freedom of Information Officer.

 

Complaints may be submitted by e-mail to [email protected], through the FOI portal www.foi.gov.mt via the E-ID or through the online form.

 

The complaint should be addressed to the Public Authority’s FOI Officer, who shall bring the complaint to the attention of the officer responsible. The officer responsible shall reply to the applicant within 10 working days from the receipt of the complaint. The applicant shall also be informed that he or she may appeal the decision or otherwise address a complaint to the Information and Data Protection Commissioner in accordance with the Freedom of Information Act (Cap. 496 of the Laws of Malta).
