1. Background

In May 2018, the EU adopted four directives on waste, known as the “Waste Legislative Package”, as part of the Circular Economy Action Plan. The overarching aim of the new Waste Legislative Package is to improve waste management, with a view to reflecting the EU’s ambition to establish a true circular economy within the EU.

The four directives amend a number of existing EU directives relating to waste, as follows:

  • Directive (EU) 2018/849 of the European Parliament and of the Council amending Directives 2000/53/EC on end-of-life vehicles, 2006/66/EC on batteries and accumulators and waste batteries and accumulators, and 2012/19/EU on waste electrical and electronic equipment;
  • Directive (EU) 2018/850 amending Directive 1999/31/EC on the landfill of waste;
  • Directive (EU) 2018/851 amending Directive 2008/98/EC on waste; and
  • Directive (EU) 2018/852 amending Directive 94/62/EC on packaging and packaging waste.

The transposition of these directives into national legislation necessitated a number of amendments to existing waste legislation, as well as the drafting of new regulations, such that a total of seven Legal Notices have been drafted.

The draft Legal Notices are being published online together for the purposes of this public consultation exercise due to the cross-referencing contained within and their interlinked nature.

2. Comments

Any comments on the abovementioned draft Legal Notices are to be submitted to ERA by 2nd November 2020 (Closing date extended to 16th November 2020) at the latest, on the following email address: [email protected].

The Ministry for the Environment, Climate Change and Planning and the Environment and Resources Authority shall take into consideration your concerns and comments as far as possible.

Please be informed that comments submitted, together with the identity of the contributor, may be published online at the end of the public consultation, unless the contributor objects to the publication of his/her personal data. In this case, the contribution may be published in anonymous form.

 

3. Consultation sessions

ERA held two (2) public consultation sessions through an online procedure, in order to present the draft Legal Notices and better explain their application.

In order to attend (virtually) for either one or both of the consultation sessions, members of the public were kindly requested to register through the relevant link/s below by latest Friday, 9th October 2020.

  • Session 1: Monday, 12th October 2020 from 16:00 to 18:00:

This session focused on the amendments to the Waste Regulations and the Waste Management (Landfill) Regulations.

This session focused on the new Extended Producer Responsibility Framework Regulations, as well as the amendments to existing waste legislation on packaging, batteries, end-of-life vehicles and WEEE.
